1. GENERAL CONDITIONS
1.1. These terms and conditions of sale are intended to define the rights and obligations of SÉBASTIENNE BODY JEWELRY, a micro-enterprise registered with the Chamber of Commerce and Industry of Créteil, and the client who purchases products sold by SÉBASTIENNE BODY JEWELRY on its own website www.sebastiennejewelry.com. They apply exclusively between the micro-enterprise SÉBASTIENNE BODY JEWELRY, 60 quai d’Anjou 94340 Joinville-le-Pont, SIRET Nb. 93864378000019, and any natural or legal person visiting or making a purchase via the website www.sebastiennejewelry.com.
1.2. Any order implies the acceptance of these terms and conditions of sale. The seller reserves the right to modify its terms and conditions of sale at any time. The price and conditions applicable to the order are those in effect at the time of validation by the customer of the order. The seller is a micro-enterprise and is not subject to VAT, therefore no VAT will be charged on the invoice.
For delivery outside the European Union, customs fees may be applied and are at the expenses of customer.

2. PRODUCT AND CONFORMITY
2.1. The products sold on the site SÉBASTIENNE BODY JEWELRY are followed by a description and comply with the standards applicable in France. The micro-enterprise SÉBASTIENNE BODY JEWELRY declines any responsibility in case of allergy to the materials of the jewels.

3. ORDERS
3.1. The online shop is open 24 hours a day but may be closed due to maintenance services or summer holiday period.An order placed on a French public holiday or during the weekend will be processed on the following business day.
3.2. The order will only be effective after acceptance of all payment due via PAYPAL or credit card via SHOPIFY PAYMENTS.
3.3. SÉBASTIENNE BODY JEWELRY reserves the right to cancel or refuse an order in case of dispute with the customer during a previous order.
3.4. For each order confirmed, you will receive a confirmation by e-mail.
3.5. SÉBASTIENNE BODY JEWELRY can accept orders within the limits of available stocks of raw materials and undertakes to inform the customer of the availability of the product sold on the site www.sebastiennejewelry.com at the confirmation of the order. If despite our vigilance the products are unavailable, SÉBASTIENNE BODY JEWELRY will inform the customer by e-mail, the customer will be able at this time to cancel the order and request a refund of amounts paid.
3.6. The temporary or permanent unavailability of a product can not in any way engage the responsibility of SÉBASTIENNE BODY JEWELRY, any more than it cannot open any right to compensation or damages in favor of the customer.
4. CLIENT'S OBLIGATIONS

5. PRICES AND SHIPPING COSTS
5.1. The prices of the products sold are indicated in euros, VAT not applicable, excluding transport costs. For wholesale customers, the prices of the products sold are indicated in euros, tax-free, excluding transport costs. The recommended retail prices are indicated in euros, tax-free.
5.2. The shipping and packing costs will be indicated in the customer’s basket, before the final validation of the order. (The customs duties, fees and taxes that may be levied by the authorities of the various countries are the responsibility of the buyer, in case of delivery to a country outside the trade agreements with FRANCE).
5.3. SÉBASTIENNE BODY JEWELRY reserves the right to modify the prices at any time without notice however the articles will be invoiced on the basis of the rates in force at the time of the confirmation of the order.
6. DELIVERY
6.1. Each jewel is made to order, therefore the order will be shipped after the manufacture of the jewel, within a minimum period of twenty working days after receipt of payment. For wholesale customers this time may be longer depending on the size of the order. The customer will receive an email stating that his order has been shipped, and containing the tracking number of his package. We deliver via the French Post by Colissimo. SÉBASTIENNE BODY JEWELRY shall not be held liable for any failure or delay in performing its obligations due to a force majeure event as defined by French courts.
6.2. In case of delay on delivery of more than 10 working days on the expected delivery date, if the product has not been shipped, the customer may inform us of this by registered letter with acknowledgment of receipt and request a refund of his or her order.
6.3. In case of damaged package or missing product, the customer must notify the carrier and SÉBASTIENNE BODY JEWELRY any problem within 3 days of receipt of said package.
6.4. SÉBASTIENNE BODY JEWELRY cannot be held responsible for the consequences due to a delay of routing which is not their fault.
7. WARRANTY, REFUND AND EXCHANGE

7.2. We will accept returns on unworn and unaltered jewelry for up to 14 days of delivery. Please reach out to contact@sebastiennejewelry.com , to initiate a return request. See our page https://sebastiennejewelry.com/policies/refund-policy.
7.3. Personalized or custom-made models cannot be exchanged or refunded.
7.4. If an item is defective and you wish to return it for an exchange, please contact us within 14 days of receipt of the product at contact@sebastiennejewelry.com. Please return the item in its original packaging to the address you will receive by e-mail. We will take care of the return shipment.
7.5. SÉBASTIENNE BODY JEWELRY offers a one-year warranty from the date of delivery for all products purchased through our website. This warranty covers manufacturing defects and ensures that any product found to be defective due to craftsmanship or materials will be repaired free of charge. The warranty does not cover damage caused by misuse, accidents, wear and tear, or modifications made to the product by the customer or third parties. To initiate a repair request, please contact us at contact@sebastiennejewelry.com within one year of receiving your order, providing your proof of purchase and photos of the product showing the issue. If the product is deemed eligible for repair, you will receive instructions on how to return it to us. We will cover the return shipping costs for eligible repairs. Please note that this warranty applies only to the original purchaser and is non-transferable.
7.6. If your jewelry is no longer covered by our warranty, we offer an after-sales service for repairs or maintenance of our products. Please contact us for more information on available services and associated costs. We will provide a quote for repairs or maintenance and guide you through the process.
8. PERSONAL DATA
8.1. SÉBASTIENNE BODY JEWELRY undertakes not to use or transmit to any person any personal data concerning its customers and to use this information strictly within the framework of its website.
Personal information is subject to computer processing, the customer acknowledges his or her awareness of this.
8.2. 10. CONFLICT RESOLUTION
10.1. In case of litigation, an amicable solution will be sought before any legal action. Otherwise, any lawsuit will be brought before the courts of the Registry of the Commercial Court of Créteil, 1 avenue General de Gaulle, Building Pascal, Building A, 94049 Créteil cedex.

10.3. If any of the stipulations of the present general conditions of sale are declared void or not enforceable by a competent court, it will be declared unwritten and will not entail the nullity of the other stipulations.
